Poloo to continue 90-day jail term as court rejects appeal

Akuapem Poloo, a social media sensation, will return to the Nsawam Medium Security Prison to finish her 90-day sentence.

This comes after the criminal division of the High Court dismissed her appeal against the sentence.

The presiding Judge, Justice Ruby Aryeetey, ruled that the sentence handed down by an Accra Circuit Court last April was not excessive on the surface and thus would not be overturned.

“The court will only intervene if it believes the sentence is manifestly excessive.” This court will not interfere with the court’s sentencing because the sentence was not manifestly excessive. “This appeal is dismissed,” said Justice Aryeetey.

Rosemond Brown, the controversial social media personality, made headlines when she posted nudes of her then-7-year-old son on social media in an unusual celebratory style.

She was accused of violating the son’s dignity and rights.

Her subsequent 90-day jail sentence, however, was described as harsh by her lawyers, and she appealed it.

However, in an apparent defence of the trial court, Justice Aryeetey stated: “It is clear from the trial document that the trial judge exercised her discretion judiciously.” I believe that the trial court considered all of the mitigating factors raised by the appellant’s attorney and in the appeal. The trial judge also took into account all aggravating factors before imposing the custodial sentence.”

Her Ladyship believes that “the trial judge imposed a harsh sentence to serve as a deterrent to others from committing the same crime.”

As a result, the High Court ordered that the child at the centre of the prosecution be given to another family member who is capable of caring for him.
